Our Policies in In Layman’s Terms

EchoED utilizes best-in class data collection applications and information security measures, and personnel training.  We NEVER EVER share your data with third parties. EchoED strives to be good steward surrounding collection, use, maintenance and disclosure of personal information from children and families. EchoED collects the least amount of information necessary to fulfill our obligations to our partners. EchoED does not include sensitive or protected data in email notifications or confirmations. Simply put, we NEVER EVER share your data with third parties. EchoED encrypts data, password protects accounts, encrypts specific Personally Identifiable Information in forms, and takes great care to guarantee data privacy and eliminate risk.

Terms of Service

You the user, hereinafter the USER, attests that the information provide in this electronic form is true and complete and that in your role you have the authority to request and authorize that a qualified EchoED interpreter relays communications on your behalf, to the given student's parent, guardian, or adult caregiver. You understand that by providing your member information, you confirm that you are authorized to add your email and phone number and give Grindstone Learning LLC DBA EchoED permission to contact you about your EchoED account via automated calls, texts or emails to service your accounts, investigate fraud, or collect a debt, but NOT for telemarketing. The USER attests that he/she will not post or transmit any submission that is unlawful, false or misleading, grossly offensive, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, pornographic, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable. USER understands that the content, scripts/talking points, form and function of the EchoED Script Generator & After Hours service applications are the intellectual property of GRINDSTONE LEARNING LLC. USER attests that he/she will not duplicate, disseminate or transmit any information that infringes or violates copyright, trademark, trade secret, patent or other proprietary right; or use or distribute EchoED trade secrets in violation of a duty of confidentiality, fiduciary duty, or similar duty.

EchoED Non-Disclosure &Confidentiality Agreement

For the Protection of Provider, Client, and Recipient/Patient Records Information

Translation and interpreting are serious work. Information security and confidentiality are of the utmost importance to EchoED and it is EchoED’s obligation to protect client’s (teachers, students, parents, patients etc.) information. Such information includes data related to educational assessments, performance tasks, legal and medical. The nature and quality of an individual’s performance and personal information must not be released. We are certain that you share our concern that all client’s information be handled in a professional and confidential manner. Please read and understand the Confidentiality & Non-Disclosure Agreements and the Terms of Service below.

Information security and confidentiality are matters of serious concern for all persons who have access to staff information and client education, health and medical records. The Health Insurance Portability and Accountability Act of 1996 (HIPAA) Privacy Rule (Code of Federal Regulations, Title 45, Part 164) governs how “covered entities” may use and disclose “protected health information.” The information contained in “educational records” is protected by the Family Educational Rights and Privacy Act (FERPA) of 1974. (20 U.S.C. 1232g(a)).

This Confidentiality Agreement is intended to help protect “personal”, educational, health or medical staff and student information that may be included in, but not limited to, any communication or correspondence from any source or in any form, i.e., paper, magnetic or optical media, conversations, film, etc. The intent of the above laws is to assure that individually identifiable staff and student information will remain confidential through its use, only as a necessity to accomplish the EchoED’s mission and obligation to our partners (schools, hospital, clinics, NGO, individuals etc.).

As a condition to access, receive or deliver any form of individually identifiable staff and student information identified above, GRINDSTONE LEARNING LLC, the undersigned Contractor hereinafter GSL, agrees to comply with the following terms and conditions for the management of spoken, written, or electronic information or communication concerning client’s information at the school, institution, or organization.

1. GSL will comply with all policies and procedures and other rules relating to confidentiality of spoken, written, or electronic staff and student information as outlined by the Department of Education (DoE), and Federal law.

2. GSL will access and utilize only staff and student information that is necessary for the performance of our work, and I will not attempt to access any staff or student information except that which is necessary on a need-to-know basis to perform certain aspects of our job or duties.

3. GSL “electronic information password” or computer password (henceforth to be known as password) is equivalent to its LEGAL SIGNATURE and GSL will not disclose this password to anyone or allow anyone to access electronic information using its password.

4. GSL understands that is responsible if another individual accesses confidential staff or student information using the EchoED platform and that GSL is responsible and accountable for all entries made and all retrievals and disclosures accessed under its password, even if such action was made by a computer application unattended while signed on.

6. If GSL has reason to believe that the confidentiality of the EchoED platform has been compromised, GSL will immediately change its password and notify individual users (teachers and the school/institution’s) and/or their Security Officer of the suspected security breach.

7. GSL will not disclose any confidential staff or student information unless required to do so in the official capacity of its employment or contract or legal hearing/subpoena

8. GSL will refer public records requests through the District Information Office of the local education agency (LEA).

9. GSL may only divulge student information that may be allowed by law with the proper release of information signed by a parent/guardian, or a student of legal age and I will not discuss in public or private any protected information without prior release of information.

9. GSL also understands that it has no right or ownership interest in any staff or student information.

10. GSL understands that information accessed in writing or verbally via any data source (i.e., educators, healthcare professionals, caseworkers) may contain sensitive and confidential provider and client information, which should only be disclosed to those authorized to receive it.

11. GSL agrees that disclosure of confidential staff or student information is prohibited indefinitely, even after termination of business relationship, unless specifically waived in writing by the authorizing party(s).

12. GSL will respect the confidentiality of any reports, and handle, store, and dispose of these reports appropriately.

13. The confidentiality requirements of this agreement shall survive its termination, expiration, or cancellation.

14. This business relationship may be revoked at any time, for any reason, and abuse or improper usage by GSL may be the basis for termination of contract or corrective action.

18. GSL will at the termination of its contract delete/deidentify all confidential data (provider and client) from all equipment used during the course of its business relationship with the school/institution within 90 days.

As a business providing services for the school/institution, GRINDSTONE LEARNING LLC, understands that state and federal law and require confidentiality and privacy protections for records and information about providers, clients, and service recipients. GSL understands that there is corrective action for handling breaches of confidentiality whether spoken, written, or electronic. GSL will abide with the Non-Disclosure and Confidentiality Agreement outlined above, with the understanding that if any of the above terms are violated, GSL may be subject to disciplinary action including civil or criminal proceedings, restriction of electronic access, termination of contract or any other legal remedy available to the institution/organization. GSL accepts its obligation to maintain the confidentiality of provider, client, and recipient information and agrees to abide by the terms of this agreement.
